October 17 2011 – Renewable Energy: Approvals and Challenges in Ontario

A paper given by Paul Manning at the Law Society of Upper Canada’s Six Minute Environmental Lawyer October 2011.

The streamlining of renewable energy approvals  Ontario into a single Renewable Energy Approval  was designed to assist Ontario’s push for increased renewable energy resource to replace its coal-fired generation facilities, due for closure by 2014. As a result, opponents have an uphill battle to challenge new projects. This paper outlines the changes to the regime, what is required to obtain an REA and how the jurisprudence on challenges has developed.
